Ministerial Accountability and Competency Benchmark Framework
Problem
The petition seeks a transparent, merit-based and legally enforceable framework for the appointment, performance and accountability of Ministers in India. It is non-partisan, targets no individual, political party or government and aims to strengthen constitutional governance, uphold public trust and ensure that every Minister exercising executive authority remains accountable to the people. India, the world's largest democracy, is home to over 140 crore citizens whose lives, health, education, livelihoods and security are directly affected by decisions of the Union Government. Ministers hold constitutional offices with significant executive powers and administer ministries that shape the nation's future. Such authority must be matched by competence and accountability. There is no transparent competency framework, eligibility benchmark or objective criterion for assigning Ministers to portfolios. Although civil servants and experts assist in policymaking, Ministers remain the final executive authority responsible for approving, supervising and defending ministerial actions. Under the constitutional doctrine of ministerial responsibility, executive authority must be accompanied by accountability. India lacks an institutional mechanism requiring Ministers to accept responsibility when serious policy failures or gross administrative negligence cause avoidable deaths, major public financial loss or widespread public harm. The Constitution guarantees equality before the law and protection of life and personal liberty. Where an independent judicial or statutory inquiry finds that avoidable deaths or serious public harm resulted from gross negligence, reckless executive decisions, willful disregard of expert advice or failure to discharge statutory duties, the concerned Minister should be required to demit office pending constitutional, administrative or legal proceedings. Accountability must arise from law not political discretion, public pressure or personal morality.
Proposed Solution
This Petition respectfully prays that Parliament enact a "Ministerial Accountability and Competency Act" to strengthen constitutional governance, transparency and public trust. The Act should: 1. Establish a "National Ministerial Competency Framework" prescribing objective, portfolio-specific benchmarks for education, administrative experience, domain expertise, leadership, integrity and public service, without affecting the Prime Minister's constitutional powers under Articles 74 and 75. 2. Mandate induction training and periodic capacity building for every Union Minister on constitutional governance, ethics, public finance, disaster management, evidence-based policymaking and ministry-specific responsibilities. 3. Establish an "Independent Ministerial Accountability Commission" to examine significant governance failures and recommend corrective measures. 4. Provide a statutory mechanism requiring the concerned Minister to demit office where an independent judicial or statutory inquiry concludes that serious executive misconduct or gross administrative negligence resulted in avoidable loss of life, serious public harm, or substantial public loss, pending completion of constitutional, administrative, or judicial proceedings. 5. Strengthen Parliamentary oversight through Standing Committee reviews and institutional mechanisms for citizen feedback. These reforms reinforce responsible government, ministerial accountability, the Rule of Law, and the constitutional principle.
