Stop the Release of Kala Hiran: The Battle for Legacy
Problem
To issue an immediate stay and ban on the production, promotion, and public release of the upcoming film Kala Hiran: The Battle for Legacy. This film exploits ongoing sub-judice legal matters, infringes upon legally protected personality rights, and deliberately creates a biased public narrative that damages the reputation and dignity of actor Salman Khan while the legal process is still active under the Indian judiciary. 1. Violation of the Sub-Judice Principle & Right to a Fair Trial The 1998 blackbuck poaching case remains under judicial scrutiny, with appeals and legal proceedings continuing in the higher courts. Releasing a commercial feature film directly dramatizing or heavily referencing these events compromises the fundamental principle of a fair trial. Entertainment media must not be allowed to act as a parallel, unregulated court that influences public opinion and prejudices a matter that is sub-judice (under trial). 2. Direct Infringement of Personality and Publicity Rights The promotional materials, teasers, and posters for Kala Hiran: The Battle for Legacy make blatant, unmistakable references to Salman Khan. By mimicking distinct, uniquely identifiable personal attributes—such as his well-known signature bracelet and likeness—the filmmakers are engaging in unauthorized commercial exploitation of an individual's identity without consent. This stands in clear violation of established legal protections regarding personality rights. 3. Malicious Intent to Sensationalize and Defame The primary focus of this film appears to be the commercial exploitation of a highly sensitive legal controversy. By utilizing unauthorized character resemblances alongside provocative imagery (such as holding a firearm despite legal acquittals in related Arms Act proceedings), the project spreads a false, highly sensationalized narrative. This is a deliberate attempt to tarnish a public figure's hard-earned reputation, goodwill, and social respect for financial gain.
Proposed Solution
Our Demands: Immediate Stay on Certification: We urge the CBFC to withhold certification and refuse the public screening of Kala Hiran: The Battle for Legacy. Cease and Desist Promotional Material: Demand that the filmmakers immediately remove all promotional material, teasers, and posters that illegally exploit Salman Khan's likeness and personality. Protect Judicial Integrity: Ensure that commercial cinema cannot be weaponized to conduct a "media trial" against any individual while the judiciary is actively deliberating on the matter. Sign this petition to stand up for judicial fairness, protect individual personality rights, and prevent commercial media from replacing the rule of law!
